1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and DineshKP Ventures (OPC) Private Limited (“Company,” “we,” “us,” or “our”), operating as safetodeploy.dev, with its registered office at Coimbatore, Tamil Nadu, India – 641062.

By accessing or using the safetodeploy.dev website, platform, APIs, or any related services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms, in which case “you” refers to that entity.

3. Description of the Service

safetodeploy.dev provides automated security validation for staging, preview, and production web environments. This includes security scanning, SEO auditing, uptime monitoring, and AI-generated remediation advice. The Service scans only publicly available endpoints and does not require or request access to private source code, databases, or internal networks.

4. Domain Authorization & Permitted Use

You may only register and scan domains that you explicitly own or for which you have written authorization from the domain owner to perform security and SEO audits. By registering a domain with the Service, you represent and warrant that:

• You are the legal owner of the domain, or you possess written permission from the domain owner to conduct automated scanning.
• Your use of the Service will not violate any applicable law, regulation, or the rights of any third party.
• You will not use the Service to scan, probe, or monitor domains belonging to third parties without their explicit consent.

We reserve the right to request verification of domain ownership at any time and to suspend or terminate your access if authorization cannot be confirmed.

5. Acceptable Use & Fair Use

You agree not to use the Service to:

• Scan, probe, or conduct reconnaissance on domains you do not own or have authorization to audit.
• Abuse the uptime monitoring infrastructure, including excessive polling beyond the configured intervals or using our pings to generate artificial traffic.
• Perform or facilitate denial-of-service attacks, exploit vulnerabilities discovered through the Service, or engage in any form of malicious activity.
• Reverse-engineer, decompile, or attempt to extract the source code or algorithms of the Service.
• Resell, redistribute, or sublicense access to the Service or its outputs without our prior written consent.

We reserve the right to immediately suspend or permanently ban any account that we determine, at our sole discretion, is abusing the 1-minute heartbeat infrastructure, conducting unauthorized scans, or using the platform for malicious reconnaissance. No refund will be issued for accounts terminated due to policy violations.

6. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@safetodeploy.dev if you become aware of any unauthorized use of your account.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

safetodeploy.dev provides automated security scanning, SEO auditing, and AI-generated remediation advice. However, we do not warrant or guarantee that:

• The Service will detect all vulnerabilities, misconfigurations, or security threats affecting your domains.
• Your platform is entirely secure, immune to breaches, or free of vulnerabilities after using the Service.
• AI-generated remediation advice is accurate, complete, or suitable for your specific environment without independent review and testing.
• The Service will be uninterrupted, timely, secure, or error-free.

You acknowledge that automated scanning tools have inherent limitations and that the Service is intended to supplement, not replace, professional security assessments, penetration testing, and manual code review.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DINESHKP VENTURES (OPC) PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunity.
• Damages resulting from hacking, data breaches, or unauthorized access to your systems.
• Damages resulting from downtime, service interruptions, or data loss.
• Costs of procuring substitute services.
• Any damages arising from your reliance on AI-generated remediation advice.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER BASIS, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless DineshKP Ventures (OPC) Private Limited and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to your use of the Service, your violation of these Terms, or your scanning of domains without proper authorization.

10. Intellectual Property

The Service, including its design, features, code, documentation, and all related intellectual property, is and remains the exclusive property of DineshKP Ventures (OPC) Private Limited. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

Scan reports and AI-generated remediation advice produced by the Service for your domains are licensed to you for your internal use. You may not publicly redistribute or resell these outputs as a standalone product.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, 10, and 13 shall survive termination.

You may terminate your account at any time by contacting us at hello@safetodeploy.dev. We will delete your data in accordance with our Privacy Policy.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after any modifications constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Tamil Nadu, India, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu, India.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
